店舗の営業開始要件

海外の加盟店が現地で店舗をオープンするまでに色々と準備／取得してもらない
といけない項目があると思いますので、それらを一つ残らず列記します。
例えば以下のようなことが考えられます。特に(b)の関係省庁からの許認可の
取得について、海外におけるFCビジネス開始のための規制が日本よりも厳しい
国も多いですので重要です。

(a)必要な保険の付保（例：製造物責任保険、火災保険等）

(b)関係省庁からの許認可の取得

(c)保健所への届け出

(d)近隣住民への説明

(e)スタッフがもっていなければならない資格（例：調理師免許等）

なお、多くの場合加盟店が店舗をオープンする期限を設け、その期限までに
オープンできなかった場合はFC本部がフランチャイズ契約を解除できる旨を
規定したりすることが多いですので、上記の開始要件を期限までにしっかりと
加盟店に満たしてもらうことが重要なポイントになります。

Article ●. Requirements for Opening of Shop

For the purpose of the opening of Shop, Franchisor shall conduct the following support (hereinafter called “Opening Support”).

Support for the research around the location of Shop
Support for the establishment of the concept of Shop
Support for the arrangement of kitchen instrument
Support for the making menu
Support for the planning in respect of income and expenditure for Shop

 Franchisee shall pay to Franchisor two hundred and thousand Japanese
Yen (200,000 JPY) for Opening Support by the due date designated by Franchisor.

Franchisee shall notify Franchisor of the opening date of Shop immediately
after it is decided prior to the opening thereof. Franchisee shall open
Shop within six (6) months on and after Effective Date. Franchisor may
terminate this Agreement in case that Franchisee failed to open Shop
pursuant to the aforesaid manner.

Franchisee shall, prior to the opening of Shop, complete all necessary
application to related authorities pursuant to the laws and regulations
in Hong Kong and obtain any and all necessary license and approval for
the opening of Shop therefrom.

Franchisee shall, prior to the opening of Shop, obtain any and all
appropriate insurances necessary for the operation of Shop and
provide Franchisor with the copy of insurance policy thereof.
